2. Our service

Last Percent provides self-service portable power bank rental stations in participating venues and locations. You may rent a power bank through a Last Percent station and return it to a compatible Last Percent return station.

The power bank remains the property of Last Percent at all times. You are renting it temporarily and do not acquire ownership of it.

3. Eligibility

You must be at least 18 years old and legally able to enter into a contract to rent a power bank. You must provide valid payment details and use the service only for lawful personal use.

4. Rental price and payment

The rental price, rental period, any payment authorisation or deposit, and the maximum charge for an unreturned, lost or damaged power bank will be displayed on the station before you confirm your rental.

By confirming your rental, you authorise Last Percent and its payment processor to charge the payment method you provide for the rental and any properly due charges under these Terms.

Payments are processed through Stripe or another authorised payment provider. Last Percent does not guarantee that every payment method will be accepted.

5. Starting your rental

Your rental begins when the station successfully releases a power bank to you. Check that the power bank appears undamaged before use. If it is damaged, overheating, swollen, leaking or otherwise unsafe, do not use it and contact us as soon as possible.

If the station charges you but does not release a power bank, contact us with the location, time of rental and payment reference. We will investigate and provide an appropriate remedy where required.

6. Returning the power bank

You must return the power bank to a compatible Last Percent station as soon as you have finished using it. A rental only ends when the station accepts the power bank and confirms that your return has been recorded.

Do not force a power bank into a station. If a station will not accept a return, take a photo or video where possible and contact us promptly using the support details above.

You remain responsible for rental charges until the return is successfully recorded, unless the failure to record the return was caused by Last Percent or the station and you notify us promptly with reasonable evidence.

7. Lost, unreturned or damaged power banks

You are responsible for keeping the power bank reasonably safe while it is in your possession. You must not sell, lend, alter, dismantle, misuse or deliberately damage it.

If a power bank is not returned within the time displayed before rental, or is lost, stolen, seriously damaged or tampered with while in your possession, Last Percent may charge the clearly displayed lost, damaged or unreturned power bank charge, except where the issue was caused by us.

Ordinary wear from normal use is not damage. Any charge will be limited to an amount that is fair and properly disclosed before your rental begins.

8. Safe use

You must use the power bank safely and responsibly. In particular, you must not:

• use a visibly damaged, swollen, leaking or overheating power bank;
• expose it to water, fire, extreme heat or direct sunlight for prolonged periods;
• pierce, crush, dismantle, modify or attempt to repair it;
• use it for medical equipment, emergency equipment or any safety-critical purpose;
• use non-standard cables or adapters in a way that could damage the power bank or your device;
• use the station or power bank for unlawful, fraudulent or abusive purposes.

Stop using the power bank immediately if it becomes unusually hot, smells unusual, leaks, swells or appears damaged.

9. Your phone and data

You are responsible for checking whether your device is compatible with the charging cables provided. Charging speeds, battery performance and compatibility can vary depending on your phone, cable, case, battery condition and settings.

Last Percent is not responsible for loss of data, missed calls, missed messages or other indirect loss resulting from your phone running out of charge, provided that this does not affect any legal rights you may have.

10. Venue responsibility

The venue hosting a Last Percent station is normally not a party to your rental agreement. Your agreement is with Last Percent Ltd.

This does not limit any responsibility a venue may have under law for its own actions or failures.

11. Refunds and service problems

If you believe that you have been charged incorrectly, contact us as soon as possible with the station location, approximate rental time and payment details.

We will investigate the issue and, where appropriate, provide a refund, replacement, price reduction or another remedy in line with your legal rights.

Nothing in these Terms removes or limits your rights under Irish consumer law.

12. Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any liability that cannot legally be excluded or limited.

Subject to the paragraph above, Last Percent is responsible only for losses that are a reasonably foreseeable result of our failure to meet our obligations.

13. Privacy

We process personal data in accordance with our Privacy Policy. This includes information needed to provide rentals, process payments, prevent fraud, deal with customer support and meet legal obligations.

14. Changes to these Terms

We may update these Terms from time to time. Updated Terms will apply to rentals started after the revised version is published. They will not retrospectively change the agreed price or conditions of a rental already in progress.

15. Governing law

These Terms are governed by Irish law. Any dispute may be brought before the Irish courts, subject to any mandatory consumer protection rights that apply in your country of residence.
